This Advanced Workshop will provide the participant an understanding of the Contract Administration Processes to follow (in case of above type of events happening) including: (1) Notices and other communications to be sent, (2) Responding to the Notices Received, (3) Documentation of Evidence, (4) Mitigating the damage caused by the effects, (5) Revising defective data or documents, (6) Negotiating and settling the disputes and disagreements, (7) Preparing and submitting claims, (8) Analyzing claims submitted by other party, (9) Payment for claims, (10) Payment retentions, (11) Monitoring progress, (12) Assisting the other party, (13) Instructing the contractor, (14) Acting on safety and other violations of the law etc..
Literal reading of the Contract is never adequate to understand the Contract Administration Actions and Strategies required to be followed. These will be discussed in detail during the program. For example if an unanticipated electric cable is found in an excavation and it disrupts contractor's works, and say the Contract allows Contractor to Claim the Impact Cost and Time, what site evidence to collect and keep to prove your contention before the site is changed and the evidence disappears - maybe in this case: Photographs, Extend to Impacted Works, Idle Equipment only Due to this Cable, mitigation opportunities available, contractor's diligence in resolving the problem, alternate works available and so on.
In this program the participant will be introduced to the analysis that must be followed to determine the Contract Administration Actions and Knowledge Checklists of possible actions to consider in any similar disruptive situation.
After attending the program the participant will appreciate that Contract Administration is not just the following of the procedures, Rules and Interpretations mentioned in the Contract and Above. A key performance expectation from Contract Administrators is Not Only to Help Complete the Project Meeting its Usual objectives of Quality or Specifications, Time and Budget, but also, helping meet the Strategic Objectives of your Organization from the Project.
The participant will be fully briefed about these aspects during the program. With this expertise he will be able to show Project and Contract Administration leadership on his projects.
