What is Covered in this Program

  1. This Advanced Contract Management program will show the participants how Contracts define the rights, responsibilities, liabilities, risks taken and scope of work for each party on the Project.
    This advanced program will communicate the Good and Best Management Practices for each of these Contract Management Processes, including: (1) Contract Planning, (2) Contract Drafting, (3) Contract Clarifications, (4) Signing the Contract, (5) Contract Administration, (6) Variations Handling, (7) Value Engineering Contractual Implementation, (8) Disputes & Claims Handling, (9) Negotiations, (10) Settlement of Claims, (11) Contract Closedown, (12) Reviewing and Monitoring Contractor submitted Quality Assurance Plans, Contractor Quality Control Plans and Contractor Risk Management Plans.
  2. This Advanced Workshop will communicate the contract administration actions each party have to perform to help complete the projects responsibilities in an orderly manner and with productivity. The program will discuss detailed aspects of what happens when one of the parties fails to perform its obligations as mentioned, and this failure caused loss or damage to the other party, then the injured party has a right to ask for a claim to compensate its losses.

Contract Managers must ensure their professionals perform their Contract Administration and Management jobs as envisaged in the Contract and as required to protect their organization interests.
Contract Managers will guide the Contract Administrators and Site Professionals to ensure they do the needful to keep their organization protected and ensure Project Objectives are not Negatively Impacted, including: (1) Ensuring the contractor has provided : the Permits, Approvals, Plans and other Documents, Insurance Certificate and so on. (2) Checking if Contractor Submitted documents are Valid (say, not expired). (2) Responding to Contractors Communications and Notices. (3) Collecting Evidence form the Site in case of Contractor request for Claim, (4) Managing Owner issued Variation Orders; (5) Handling Contractor Requested Variation Orders; (6) Reviewing Contractors request for payment for Variations and Claims; (7) Checking to see if the Contractor is Complying with his other Contractual Obligations, and so on.

  1. This Advanced Contract Management program will provide the Contract Manager Skills to Support Development and Updating of a Contract Management Manual covering, for each of above processes (1) Details of the Work Required to be performed. (2) Procedure to be follow. (3) Liability causing Behavior to avoid. (4) Quality Assurance System to Establish. (5) Records to be Maintained. (6) Disputes that may arise. (7) Steps to Mitigate the Impact of any Disagreements. (8) Other Stakeholders to inform or consult. (9) Dispute Resolution Strategies. (10) Any Domain Knowledge to be familiar with and consult. (11) Productivity Templates and Knowledgebase to build.
  2. This Advanced program will discuss the Methodology to follow to Develop Meaningful Performance Indicators and KPIs for the above Contract Management and Administration Activities.
    This Advanced Workshop will also discuss the methodology to develop a Near Real Time Contract Management Performance and Decision support Dashboard. This dashboard will provide Real Time or Proactive Decision Support and Actionable Insight for the Contract Manager, Contract Staff, Project Professionals, and other project stakeholders.

The participant can elect to work on any one of these Project Contracts as part of the program case studies or workshops: Traditional Construction Contract Civil or Industrial, Turn Key or Engineering Procurement Construction (EPC) or Design & Build (DnB) Contract, Build Operate Transfer or B-O-T Contract, Project Design Contract, or Major Procurement Contract.
