Within this reduced risks Turnkey Project Contract Administration, Claims Management and Resolving Disputes requires a Complex interrelated understanding and competencies in Legal, Contract, Technical, Design, Industry Practice, Strategic, Estimating, Value Engineering, Audit and Negotiations. This unique program specializes in providing such a multi-discipline understanding to help save your projects from Delays, Cost Overruns, Disputes, Claims and other Strategic Failures. Turnkey Project Contract Administration, Claims Management and Resolving Disputes requires a Complex interrelated understanding and competencies in Legal, Contract, Technical, Design, Industry Practice, Strategic, Estimating, Value Engineering, Audit and Negotiations Aspects. This unique program specializes in providing such a multi-discipline understanding to help save your projects from Delays, Cost Overruns, Disputes, Claims and other Strategic Failures.
  2. This Advanced Workshop will show, many risks can happen on Turnkey projects. By Contracts and Law Owner takes responsibilities for some of these risks, but, many of the risks fall under the Contractor Liability. The Contract between the parties may put obligations to communicate or give notices to the other side in case certain types of events occur during performance. Protection of party's rights may be contingent on such timely notices and communications. Also, disagreements and disputes occur as to interpretation of contractual obligations and impact of events, the liability outcome of these often depends on the contract, actual sequence of events and actions of the parties. This Advanced Workshop will provide the participant an understanding of the Turnkey Project Contract Administration Actions and Processes to follow in case of above situations arise. Program will explain the need, logic and methods for : (1) Notices and other communications to be sent, (2) How to Responding to the Notices Received, (3) How to Document supporting facts as evidence, (4) Essential efforts for mitigation to protect rights, (5) Revising defective data or documents submitted, (6) negotiating and settling the disputes and disagreements, (7) preparing and submitting claims, analyzing claims submitted by other party, (8) Win-win settlement of claims, (9) payment retentions, (10) problem monitoring, (11) progress monitoring, (12) assisting the other party, (13) situations requiring instructing the contractor, (14) acting on safety and other violations of the law and so on.

Literal reading of the Turnkey Project Contract is sometimes not adequate to understand the Contract Administration Actions and Strategies required to be followed. The correct Contract interpretation requires not only reading the Contract Literally but also applying some legal rules, doctrines and precedents, these then dictate the required Contract Administration Actions. Dispute outcome and ease of resolution can be assisted by proper and timely mitigation and documentation steps when the problem occurs and nobody may have mentioned any notice or claim. It is the contract administrator job to arrange for appropriate evidence be collected from the site before it disappears, including: Photographs, Extend to Impacted Works, Idle Equipment only Due to this event, mitigation opportunities available, contractor's diligence in resolving the problem, alternate works available and so on.

  2. For each of the above Key Turnkey Contract Conditions the participant will learn what Contract Administration Actions are required to protect his organizations Objectives on the project. This Advanced Workshop will further discuss what needs to be done to meet one key performance expectation from Contract Administrators to help meet the Strategic Objectives of your Organization like Professional Reputation, Image, Standardization and so on. The participants will be fully briefed about these aspects during the program.
This Advanced Workshop will show that protecting against inflated amounts claimed requires Contract Administrators collect evidence of: (1) Concurrent Delaying Events that are the responsibility of the other party, (2) Identifying non allocable costs to the claim calculations, (3) Double charging hidden in claim calculations, (4) Excessive losses due to lack of mitigation by other party, (5) Inappropriate calculation methods employed to quantify the claims and so on.

  4. Accommodation is not included in Program fee. Special rates will be available at venue hotel for the class room training program participants.
  5. Special discount of 10% is offered for participants who pay their fees at least 45 days before start of the program.
  6. Refund will not be considered where the participants cancels his registration less than 3 weeks before start of the program. Alternate nominations will be allowed anytime before program start. In case of exceptional hardship or emergency participant may be allowed to attend at another location.
